Terms of Use

These Terms of Use ("Terms") apply to Symmi Face ("the App"), the face analysis app published by TidalAurum, LLC ("TidalAurum", "we", "us") on the Apple App Store as "Symmi Face : Asymmetrical Fix". Please read them before using the App.

The short version

• Symmi measures your face for self-care and curiosity. It is not medical advice, and its readings depend on the photo.
• You must be 13 or older. If you are under 18, you need a parent's or guardian's permission.
• Subscriptions renew automatically until you cancel them in your Apple account settings. Deleting the App does not cancel them.
• Use the App only on your own face, or with the permission of the person you scan, and don't use it to judge or mock other people.

1. Agreement

These Terms are an agreement between you and TidalAurum, LLC. By downloading or using the App you agree to these Terms and to our Privacy Policy, which explains how the App handles your data. If you do not agree, please do not use the App.

2. What the App does

The App measures facial proportions and symmetry from a photo or a camera scan. It places facial landmarks, calculates readings such as angles, ratios and left–right differences, compares them with reference ranges, and on iPhones with a TrueDepth camera builds a 3D model of your face. It also offers scan tools such as face shape, color season, skin map and eye shape (hunter or prey eyes), together with facial exercise routines, habit suggestions and progress tracking. All face analysis runs on your device.

3. Who can use the App

You must be at least 13 years old to use the App. If you are under 18, you may use it only with the permission of a parent or guardian, who agrees to these Terms on your behalf. The App does not require an account.

4. Not medical advice

The App is a wellness and self-care product. It is not a medical device, and it does not diagnose, treat, cure or prevent any condition. Nothing in the App is medical, dental or psychological advice, or a recommendation for any cosmetic procedure.

Readings are measurements of a photo. Lighting, camera distance, head angle and facial expression all change them, so they can be inaccurate and can differ from one scan to the next. Scores, labels and categories (for example a face shape, a color season or an eye type) describe proportions and appearance. They are not a judgment of your worth or attractiveness.

Facial exercises, routines and habit suggestions are general wellness and appearance activities. Stop if anything hurts, and talk to a doctor or dentist before you start if you have a medical condition, pain, jaw problems or a recent injury. If your face changes suddenly, see a doctor. Bone structure does not change with exercises or habits, and we do not promise any particular result.

If using the App makes you feel worse about your appearance, please take a break and consider talking to someone you trust or to a professional.

5. Subscriptions and payments

Some features are free. Others require a Symmi subscription, currently offered as weekly and yearly plans. Subscriptions are bought through the Apple App Store and charged to your Apple account. The price and billing period are shown in the App and in Apple's purchase sheet before you confirm, and may vary by country.

Your subscription renews automatically at the end of each period, and your Apple account is charged for the next period within 24 hours before the current one ends, unless you turn off auto-renewal at least 24 hours before the end of the period. You can manage or cancel your subscription at any time in your device's Settings app under your name > Subscriptions, or in the App Store. Deleting the App does not cancel your subscription. If you cancel, you keep access until the end of the period you have already paid for.

If a free trial or introductory offer is available, its terms are shown before you subscribe. A free trial turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends, and any unused part of a free trial ends when you buy a subscription.

Payments and refunds are handled by Apple under Apple's policies; to ask for a refund, use Apple's "Report a Problem" page. We never receive your payment card details. We may change subscription prices; Apple will tell you about a price change as its rules require, and you can cancel before it takes effect. You can restore a subscription on a new device with "Restore" in the App.

6. Your photos and results

You keep all rights to your photos. Use the App only with photos of yourself, or of someone who has given you permission. Photos, scans and results are processed and stored on your device and are not uploaded to us. Your results are yours to keep and share.

7. Acceptable use

You agree not to:

• scan, rate or publish readings of another person's face without their permission, or use the App to mock, harass or rank other people;
• use the App with photos of children under 13;
• copy, resell or commercially use the App or its content without our written permission;
• reverse engineer the App, or get around its subscriptions or security measures, except where the law allows it;
• break any law while using the App.

8. Our content and your license

The App and its design, text, images, videos and software belong to TidalAurum, LLC or our licensors, and "Symmi" is our brand. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes on Apple devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.

9. Apple

You downloaded the App from the Apple App Store, so the following also applies:

• These Terms are between you and TidalAurum, LLC, not Apple. We, not Apple, are solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
• You must also comply with any applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

10. Disclaimers

The App is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the App or its readings will be accurate, uninterrupted or error-free.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to the App is limited to the amount you paid for the App and subscriptions to it in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you, and nothing here limits liability that cannot be limited by law.

12. Indemnity

If you break these Terms or use the App to violate someone else's rights, you agree to cover the reasonable losses and costs that result for us, to the extent the law allows.

13. Ending your use

You can stop using the App at any time by deleting it and cancelling any subscription in your Apple account. We may change, suspend or discontinue features, and we may end your license if you break these Terms. Sections that by their nature should survive, such as the disclaimers and limits of liability, continue to apply.

14. Changes to these Terms

We may update these Terms. The current version is always published on this page, with the date of the last update shown at the top. For significant changes we will give notice on this page or in the App before they take effect. If you keep using the App after a change, the new Terms apply; if you do not agree, stop using the App and cancel your subscription.

15. Governing law and disputes

If you have a problem, please email us first; most issues can be solved that way. These Terms are governed by the laws of the United States and of the state in which TidalAurum, LLC is organized, without regard to conflict-of-law rules. If you live outside the United States, you keep any consumer protections that the law of your country gives you and that cannot be waived.

16. General

These Terms and the Privacy Policy are the whole agreement between you and us about the App. If any part of these Terms cannot be enforced, the rest still applies. Not enforcing a right is not a waiver of it. You may not transfer these Terms; we may transfer them as part of a merger, sale or reorganization.
